Summary:

The General Counsel for UNC Health Pardee will oversee all legal matters for the organization and serve as the primary legal advisor to the CEO, senior management team, and Board of Directors. This role involves providing legal advice concerning hospital and clinic operations, compliance, and healthcare regulations; managing litigation; and supporting negotiation of contracts and agreements. The General Counsel will work closely with various departments to mitigate legal risks and support the hospital's mission of delivering quality patient care.

Responsibilities:

  • Serve as the primary legal advisor to the hospital’s CEO, senior leadership team, and Board of Directors on all legal matters, including compliance, litigation, corporate governance, regulatory matters, and employment issues.
  • Interpret and advise on laws, rulings, and regulations affecting the hospital. 
  • Provide advice concerning compliance with federal, state, and local healthcare laws and regulations, including the Health Insurance Portability and Accountability Act (HIPAA) and other privacy laws. 
  • Develop and implement policies and procedures to ensure compliance with legal standards. 
  • Develop and implement policies and procedures to protect patient privacy and secure health information. 
  • Advise concerning compliance with the Stark Law and Anti-Kickback Statute.
  • Review and advise on physician arrangements and financial transactions to prevent violations.
  • Manage and oversee all litigation involving the hospital, including malpractice claims, employment disputes, and contractual issues. 
  • Coordinate with external legal counsel as needed. 
  • Draft, review, and negotiate contracts with vendors, suppliers, and other third parties. 
  • Ensure all contracts comply with legal requirements and hospital policies. 
  • Provide training and education to hospital staff on legal issues, compliance, and risk management. 
  • Stay updated on changes in healthcare laws and regulations and inform relevant stakeholders. 
  • Advise on employment-related issues, including employee relations, discrimination, wage and hour issues, and labor law compliance. Handle internal investigations and disputes when necessary.
  • Manage the hospital’s legal budget, ensuring that legal costs are controlled, and services are provided in a cost-effective manner.
  • Work closely with other departments such as HR, risk management, finance, and IT to ensure legal issues are addressed in a timely and efficient manner.

Other information:

Required:

  • Juris Doctorate (JD) from an accredited law school
  • Active membership in the North Carolina state Bar and licensed to practice law in the state of North Carolina
  • Minimum Twelve (12) years of legal experience with at least ten (10) years of people management experience
  • Excellent negotiation, communication, and presentation skills
  • Proven track record of handling complex legal issues, including litigation, compliance, and contracts
  • Strong ethical standards, professionalism, and the ability to maintain confidentiality
  • Ability to think strategically and provide sound legal advice that aligns with the hospital's business goals and objectives
  • Experience working in a dynamic, fast-paced environment with a strong emphasis on teamwork and collaboration
